Terms & Conditions

These terms govern the use of Kukuh Law's legal services for pension matters. We have written them as plainly as possible.

1. Definitions

Throughout these Terms and Conditions, the following meanings apply:

"Service" or "Services"
Refers to the legal advisory and representation services offered by Kukuh Law, including but not limited to the Pension Clarity Consultation, Entitlement Representation, and Complete Pension Care Package.
"User" or "Client"
Any individual or entity that engages with or retains Kukuh Law for the purpose of obtaining legal services related to pension matters.
"We", "Us", or "Our"
Kukuh Law, a legal practice registered and operating in Malaysia, with principal offices at Level 25, Menara Citibank, 165 Jalan Ampang, 50450 Kuala Lumpur.
"Content"
All materials, written advice, documents, reports, and communications produced by Kukuh Law in the course of delivering the Services.
"Agreement"
The binding contract formed between the Client and Kukuh Law upon engagement, comprising these Terms and any signed retainer or engagement letter.

2. Acceptance of Terms

By contacting, engaging with, or retaining the services of Kukuh Law, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

Our Services are intended for adults aged 18 years and above. By proceeding with an engagement, you confirm that you have the legal capacity to enter into a binding agreement under Malaysian law.

If you are acting on behalf of another person — for example, an elderly parent or a deceased person's estate — you confirm that you hold the appropriate authority to do so, and you take responsibility for ensuring that person's or estate's compliance with these Terms.

3. Service Description

Kukuh Law provides legal services related to pension and retirement fund matters in Malaysia. Our core services are as follows:

Pension Clarity Consultation

A confidential review of your pension and retirement-fund records, culminating in a written summary of findings and options. Priced at RM 290.

Entitlement Representation

Representation in matters where a pension entitlement has been withheld, reduced, or delayed, covering government schemes and private retirement funds. Priced at RM 650.

Complete Pension Care Package

Comprehensive handling of a pension matter from initial review through to resolution, with one consistent point of contact throughout. Priced at RM 1,100.

Services are available to clients in Malaysia. We may decline to act in matters that fall outside our practice area or where a conflict of interest exists. Geographic or jurisdictional restrictions will be communicated at the time of engagement.

4. User Responsibilities

To allow us to serve you effectively and in accordance with our professional obligations, you agree to the following:

  • Provide accurate, complete, and up-to-date information when requested, including all pension-related documents and correspondence.
  • Respond to our requests for instructions or information within a reasonable timeframe, particularly where deadlines apply.
  • Keep your contact details current so that we may reach you throughout the matter.
  • Notify us promptly of any change in your circumstances that may affect your matter.
  • Not engage another legal representative for the same matter without first informing us.

Prohibited conduct includes:

  • Providing false, misleading, or fabricated documentation.
  • Using our services for any purpose that is unlawful under Malaysian law.
  • Attempting to use our advice to misrepresent your entitlements or those of another person.

5. Intellectual Property

All written documents, advice, letters, summaries, and other materials produced by Kukuh Law during the course of an engagement are the intellectual property of Kukuh Law unless expressly assigned to you in writing.

You are granted a limited, non-exclusive, non-transferable licence to use such materials solely for the purpose of the matter for which they were prepared. You may not reproduce, distribute, or commercially exploit these materials without our prior written consent.

Documents you provide to us in support of your matter remain your property. By providing them, you grant us a licence to use them as necessary to conduct the engagement.

6. Payment Terms

Service fees are as set out in these Terms and in any engagement letter provided to you. All amounts are stated in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless otherwise stated.

Payment is due upon engagement unless alternative arrangements have been agreed in writing. We accept bank transfer and other payment methods as communicated at the time of engagement.

If you wish to discuss payment arrangements, please contact us before commencing the service. We will consider each situation on its merits.

Refunds are considered on a case-by-case basis. Where work has already been commenced, a refund of any unused portion of the fee may be offered at our reasonable discretion.

7. Service-Specific Terms

The following terms apply specifically to our legal services in pension matters:

  • Scope: Each engagement is limited to the matter described in the engagement letter. Work falling outside that scope may require a separate arrangement and additional fees.
  • Timeline: We will communicate realistic timelines at the outset. Timelines may vary depending on the complexity of the matter and the response times of third parties such as government agencies and retirement fund administrators.
  • Confidentiality: All client information shared with us is treated as strictly confidential and handled in accordance with our professional obligations under the Legal Profession Act 1976 and the Personal Data Protection Act 2010 (Malaysia).
  • Third-Party Reliance: Outcomes in pension matters often depend on the decisions of third parties, including government bodies and fund administrators. We cannot control or commit to the actions of those parties.

8. Disclaimers

Our Services are provided based on the information available to us at the time of engagement and the law as it stands at that time. Legal positions may change, and our advice reflects the situation at the time it is given.

We do not make any representation as to specific outcomes in pension matters. Results in any individual case depend on facts, evidence, and the decisions of independent parties. Any discussion of possible outcomes is intended only to help you understand the range of possibilities, not as a commitment.

9. Limitation of Liability

To the extent permitted by Malaysian law, our total liability to you in connection with any engagement shall not exceed the fees paid by you for that specific engagement.

We shall not be liable for any indirect, consequential, or incidental losses arising from the provision of our Services, including loss of opportunity or decisions made by third-party agencies.

We are not liable for circumstances beyond our reasonable control, including delays caused by government agencies, system outages, or other force majeure events.

10. Indemnification

You agree to indemnify and hold Kukuh Law, its principals, associates, and staff harmless from any claims, losses, or damages arising from:

  • Your provision of inaccurate or false information.
  • Any breach of these Terms by you.
  • Actions taken by you contrary to our advice.

11. Termination

Either party may terminate an engagement by giving written notice. We will provide you with reasonable notice and, where appropriate, return relevant documents to you.

We may terminate an engagement without prior notice if you provide materially false information, act in a manner contrary to our professional obligations, or fail to make payment when due.

Upon termination, your obligation to pay for work completed to that point remains. Obligations related to confidentiality, intellectual property, and indemnification survive termination.

12. Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from or relating to these Terms shall first be subject to an attempt at amicable resolution between the parties.

If amicable resolution is not achieved within 30 days of written notice, the dispute shall be referred to the courts of Malaysia, with Kuala Lumpur as the agreed jurisdiction.

Clients also have the right to raise concerns with the Malaysian Bar Council if they relate to professional conduct matters.

13. General Provisions

Entire Agreement: These Terms, together with any engagement letter, constitute the full agreement between the parties regarding the subject matter.

Severability: If any provision of these Terms is found to be unenforceable, that provision shall be modified to the minimum extent necessary and the remaining provisions shall remain in full force.

Waiver: Our failure to enforce any provision does not constitute a waiver of our right to enforce it in the future.

Assignment: You may not assign your rights or obligations under these Terms without our written consent. We may assign our obligations with reasonable notice to you.

Notices: Formal notices under these Terms should be sent in writing to our office address or by email to [email protected].

14. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, applicable law, or our practices. When we make material changes, we will update the "Last Updated" date at the top of this page.

Continued engagement with our services following any update constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
